Terms of Service

These terms govern your use of the MySportIQ platform (the “Service”), operated by Zelar Solutions, trading as MySportIQ (“MySportIQ”, “we”, “us”), based in South Africa. By creating an account or using the Service you agree to these terms. If you are accepting on behalf of a school or organisation, you confirm that you are authorised to do so.

1. The Service

MySportIQ is a platform for schools to manage their sports programmes — teams, fixtures, live scoring, league tables, analytics and related notifications. We may add, change or remove features over time.

2. Accounts

• You must provide accurate account information and keep your login credentials confidential.
• You are responsible for activity that occurs under your account.
• School administrators and coaches are responsible for the accounts and information they create for their school, including obtaining any consent needed to add learner information.
• Notify us promptly of any unauthorised use of an account.

3. Acceptable use

You agree not to:

• use the Service unlawfully or in breach of any person’s rights;
• upload content that is defamatory, abusive, infringing or otherwise objectionable;
• attempt to gain unauthorised access to the Service, other accounts, or our systems;
• interfere with or disrupt the Service, or probe it for vulnerabilities without our written permission;
• resell or provide the Service to third parties except as expressly permitted.

4. Your content

Schools and users retain ownership of the information and content they enter into the Service. You grant us the licence needed to host, process and display that content for the purpose of operating the Service and providing it to you and to the school’s authorised users. Our handling of personal information is described in our Privacy Policy.

5. Subscriptions and payment

• Paid plans are billed monthly in South African Rand (ZAR), in advance, either by card or instant EFT through our payment processor PayFast, or by EFT invoice. Prices exclude VAT unless stated; VAT is added where applicable.
• Card and instant-EFT subscriptions renew automatically each month until cancelled. You can cancel at any time, effective at the end of the period already paid for.
• EFT invoices are payable by the due date shown. Use the invoice number as your payment reference.
• If a payment fails or an invoice remains unpaid after reminders, we may suspend or downgrade the school’s account until payment is received.
• Refunds are handled under our Refund & Cancellation Policy; delivery of the service is described in our Delivery Policy.
• We may change plan pricing on reasonable notice; changes take effect from the next billing cycle.

6. Availability

We aim to keep the Service available and reliable but do not guarantee uninterrupted access. We may carry out maintenance, and we may suspend the Service where necessary to protect it or its users.

7. Disclaimers and liability

The Service is provided “as is”. To the extent permitted by law, we exclude implied warranties and are not liable for indirect or consequential loss, or for loss of data, profit or goodwill. Our total liability arising from the Service in any 12-month period is limited to the fees paid by the relevant school for the Service in that period. Nothing in these terms limits liability that cannot be limited by law.

8. Suspension and termination

• You may stop using the Service at any time; a school may cancel its subscription, effective at the end of the current billing period.
• We may suspend or terminate access for a serious or repeated breach of these terms, for non-payment, or where required by law.
• On termination, a school may request an export or deletion of its data, subject to records we must retain by law.

9. Changes to these terms

We may update these terms from time to time. Material changes will be notified through the Service or by email, and continued use after the effective date means you accept the updated terms.

10. Governing law

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute.
